
On May 27, 2021, the Sixth Circuit released a choice in Vitolo v. Guzman. Over a dissent composed by Judge Donald, the court held that the Small company Act of the American Rescue Strategy Act developed unconstitutional racial, ethnic, and gender-based top priority choices in dispersing COVID relief grants to small companies. Upon discovering the complainants would win on their constitutional claim, the court gave the complainants an initial injunction pending appeal.
